By creating an account or accessing any part of the Supamart platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree to these terms, you must not use our services. These terms constitute a legally binding agreement between you and Floksminds LLP and govern your use of all features, tools, and services provided through our online supermarket marketplace, whether you are a customer or a registered store owner.
2. Use of Service
Supamart operates as an online marketplace that connects local supermarkets and grocery stores with customers in their area. Through our platform, customers can discover nearby supermarkets, browse product catalogs, place orders, and pay via cash on delivery (COD) or online payment methods. Store owners can list their products, manage inventory, and fulfill customer orders. You must be at least 18 years of age and capable of entering into a legally binding agreement to use our platform. We reserve the right to modify, suspend, or discontinue any aspect of the service at any time with reasonable notice.
3. User Responsibilities
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration, including your delivery address and contact details, and to update such information as necessary. Customers are expected to honor placed orders and fulfill payment obligations, whether through COD or online payment. Store owners are responsible for the accuracy of their product listings, pricing, and inventory availability. You must promptly notify Supamart of any unauthorized use of your account or any other breach of security.
4. Intellectual Property
All content, features, functionality, trademarks, logos, and proprietary technology available through the Supamart platform are owned by Floksminds LLP or its licensors and are protected by international copyright, trademark, patent, and trade secret laws. You are granted a limited, non-exclusive, non-transferable license to use the platform for personal shopping or authorized store management purposes. You may not reproduce, distribute, modify, reverse engineer, or create derivative works from any part of our platform, including store listings, product images, or platform design, without prior written consent.
5. Prohibited Activities
You agree not to use Supamart for any unlawful or unauthorized purpose. Prohibited activities include, but are not limited to: creating fake store listings or fraudulent product entries, manipulating prices or reviews, placing orders with no intent to pay or receive delivery, impersonating other users or stores, attempting to gain unauthorized access to our systems, interfering with the platform's infrastructure, or transmitting malicious code. Automated scraping, data harvesting, or the use of bots to interact with the platform without express authorization is strictly prohibited. Violation of these terms may result in immediate account termination and, where applicable, referral to law enforcement authorities.
6. Limitation of Liability
Supamart operates as a marketplace connecting supermarkets with customers and does not directly sell, manufacture, or guarantee the quality of products listed by stores on the platform. Product quality, accuracy of descriptions, freshness, and fulfillment are the sole responsibility of the respective store owners. To the maximum extent permitted by applicable law, Floksminds LLP and its directors, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the platform, including but not limited to issues with product quality, delivery delays, or order disputes. The platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied.
7. Termination
We may terminate or suspend your account and access to the platform immediately, without prior notice or liability, if you breach any provision of these Terms and Conditions. Common grounds for termination include repeated order cancellations, fraudulent activity, abusive behavior toward store owners or delivery partners, or posting misleading product listings. Upon termination, your right to use the service will cease immediately, and we may delete your account data in accordance with our data retention policies. You may also terminate your account at any time by contacting our support team. Provisions that by their nature should survive termination shall remain in effect, including ownership, warranty disclaimers, and limitations of liability.
8. Changes to Terms
Supamart reserves the right to update or modify these Terms and Conditions at any time. We will notify you of material changes by posting the updated terms on our platform, sending an email notification to your registered address, and updating the "Last updated" date at the top of this page. Your continued use of the platform after any changes constitutes your acceptance of the revised terms. We encourage you to review these terms periodically to stay informed about your rights and obligations.
